The arresting officer observed Mr. Finch staggering from his car to the ABC Store in Stantonsburg, where he pulled on the door several times before realizing the store was closed. The clerk later told officers Mr. Finch had been to the store earlier while it was open, and she had refused to sell him any alcohol because he appeared to already be intoxicated. The officer witnessed Mr. Finch return to his car and begin to drive down Moyton Avenue. He then conducted a traffic stop, and Mr. Finch was placed under arrest and taken to the Wilson County Jail. The arresting officer conducted a traffic stop after a radar gun confirmed that Mr. Langley was speeding on Highway 58. When he approached the vehicle, he noticed a semiautomatic handgun on the dashboard. He asked Mr. Langley to step out of the vehicle, and when he did a plastic bag with what appeared to be marijuana fell out of his pocket. A search of the vehicle was conducted, revealing a digital weigh scale and five pills, which were later determined to be over-the-counter medication.
